The Real Cost of Delayed Tax Filing and Accounting

“I’ll file it next month” is one of the most expensive sentences in business. Delayed filing does not just cost a late fee — it compounds into interest, lost credits, and in some cases genuine legal exposure. Here is what actually happens, step by step.

Late Fees Are Only the First Layer

GST returns filed late attract a late fee of roughly ₹50 per day of delay for regular returns (₹20 per day for nil returns), split between CGST and SGST, in addition to 18% annual interest on any unpaid tax. Income tax returns filed after the due date attract a fee under Section 234F of ₹1,000 to ₹5,000 depending on your income level, plus interest under Section 234A on outstanding tax. None of this is negotiable once the deadline passes.

You Lose Rights, Not Just Money

File your income tax return late and you can lose the ability to carry forward certain business losses to offset against future profits — a right that simply disappears if you miss the original due date. On the GST side, delayed filing can hold up your buyers’ input tax credit, which damages business relationships even when your own tax liability is small.

It Compounds Across Filings

GST is filed monthly or quarterly. Miss one GSTR-3B and the late fee resets every single day until you file — and you often cannot file the next period’s return until the previous one is cleared, so one missed month can freeze your entire compliance calendar. For companies and LLPs, this same logic applies to ROC annual filings, where the penalty is ₹100 per day with no upper cap.

The Scrutiny Risk

Persistent non-filing does not stay invisible. It is one of the most common triggers for a notice from the Income Tax Department or the GST authorities, and once you are dealing with a scrutiny notice instead of a routine return, the time and cost involved multiplies several times over.

File On Time

  • No late fee or interest charged
  • Losses stay available to carry forward
  • Buyers' input tax credit flows through normally
  • Compliance calendar stays unaffected next period

File Late

  • Daily GST late fee plus 18% annual interest
  • Section 234F fee and 234A interest on income tax
  • Carry-forward of business losses can be lost
  • Higher chance of a scrutiny notice

The Fix Is Almost Always the Same

Keep a compliance calendar and treat filing dates as fixed, not flexible. HATS tracks GST, income tax and ROC deadlines for our clients specifically so that filing is a routine task handled on schedule, not a fire drill after a notice arrives.

Compliance rules and thresholds are revised periodically by the government — always confirm the current fee structure with our team before you file.
